Court decides whether Östra Göinge will pay fine

The Swedish Competition Authority turned to the courts to demand Östra Göinge municipality pay 375,000 crowns in fines. The Swedish Competition Authority believes that the municipality has violated the rules for direct procurement of construction at Trollabadet.

The damage fee applies to the municipality's procurement of the construction of a new changing room and a new kiosk at Trollabadet in Glimåkra.

The procurement was worth more than 5 million crowns. So the amount was over the current framework agreement. The construction should have therefore been advertised so that more companies had the opportunity to submit tenders.

The contract is considered to be an unauthorised direct procurement.

The Swedish Competition Authority began looking at the procurement after Kristianstadsbladets wrote about how Östra Göinge handled procurement and call-off agreements in 2012-2018 in the construction sector.

The Administrative Court in Malmö will decide whether the fine will be recovered.

Östra Göinge will have the opportunity to be heard before the Administrative Court makes a decision.

- We have already stated that mistakes were made in connection with call-off agreements. Now we have to wait for the legal process, says Municipal Commissioner Patric Åberg (M).
